FACT CHECK: ICC case against Duterte is ongoing and no dismissal has been issued

FALSE: A Facebook reel claims that the International Criminal Court (ICC) has dismissed the case against former President Rodrigo Duterte.

FACT: Duterte’s case is still ongoing. The ICC has scheduled the confirmation of charges hearing for September 23, 2025. 

The ICC investigation stems from alleged crimes against humanity committed during Duterte’s anti-drug campaign while the Philippines was still a member of the Rome Statute (2011–2019). 

Although Duterte’s defense argued that the ICC lacks jurisdiction following the country’s 2019 withdrawal, the ICC maintains authority over crimes committed during its membership period.

The false claim originated from a Facebook reel that misrepresented the case status. 

As of May 2025, the ICC prosecution has disclosed 139 pieces of evidence to Duterte’s defense. 

No dismissal or acquittal has occurred, and proceedings are still in progress.
